Agreements governing the cooperation between the entrepreneur and the volunteer of Stichting Ondernemersklankbord
You have registered with Stichting Ondernemersklankbord (OKB) for an advisory programme. The following rules apply to your cooperation with OKB’s volunteer, unpaid advisor:
1. The entrepreneur remains responsible
The volunteer, unpaid advisor will assist you during your advisory programme. However, responsibility for the operation of your business, including your decisions and the considerations behind them, always remains with you. The advisor will never take over your role: all decisions are made at the entrepreneur’s own responsibility and risk. In all circumstances, the entrepreneur shall indemnify the advisor and/or Ondernemersklankbord against claims from third parties.
2. Keeping agreements and providing information
We ask you to comply with the working arrangements agreed with the advisor and to provide him/her with all relevant information, both when requested and on your own initiative. The advisor will, of course, treat all information received as confidential. If you fail to comply with the agreed arrangements, the advisor may ultimately terminate the support/guidance. The support/guidance will also be terminated if, in the opinion of either the entrepreneur or the advisor, it is no longer useful. During your advisory programme, it is of great importance that you inform your advisor of any changes in your situation so that the appropriate support can be provided.
3. Duration of the advisory programme and other matters
The support is intended to answer your business questions as efficiently as possible. The duration of the advisory programme will be determined in consultation between you and the advisor. In general, the programme lasts 6 months, unless otherwise agreed. There may also be arrangements with organisations that referred you to Ondernemersklankbord. If the agreed period proves insufficient, a new advisory programme may be arranged. The guidance ends when the advisor and/or entrepreneur considers that the objective has been achieved. You are responsible for drawing your own conclusions from the advice provided and, where necessary, taking action. As part of an advisory programme, the advisor does not perform operational or executive tasks. If the advisor considers it necessary, they may help you establish contact with third parties and may, where appropriate, attend meetings with third parties. The advisor does not write letters to third parties on your behalf, but may of course provide guidance on such letters or review drafts prepared by you.
4. Free intake meeting and contribution towards an advisory programme
Before an advisory programme begins, we first schedule a free and non-binding intake meeting. During this meeting, we discuss your business question, assess whether Stichting Ondernemersklankbord can provide the right support, and introduce you to the advisor.
If, after the intake meeting, we jointly decide that an advisory programme is appropriate, we ask for a contribution of €200 at the start of the programme.
Our advisors contribute their time, knowledge and experience entirely on a voluntary and unpaid basis. The contribution is used to support the continued operation of the foundation and its services. After the agreed advisory period, as referred to under point 3, it is possible to start a new advisory programme by mutual agreement. At the start of each new advisory programme, a new contribution of €200 will be requested.
5. Disclaimer clause
Neither the advisor – acting in their capacity as a volunteer, unpaid advisor of Stichting Ondernemersklankbord – nor Stichting Ondernemersklankbord shall in any way be liable for any loss or damage that has arisen or may arise as a result of the entrepreneur failing to comply with agreed arrangements. Nor shall the advisor or Stichting Ondernemersklankbord be liable in any way for the accuracy of information provided to the advisor by the entrepreneur and/or their accountant/bookkeeper. Given the nature of the advisory activities, neither the advisor in their personal capacity nor Stichting Ondernemersklankbord as an organisation shall in any way be liable for any loss or damage suffered or to be suffered as a result of the support/guidance provided.
